Solgen Construction LLC, 99 Cal. App. 5th 1178<\/u><\/em><\/strong><br><br>Jones purportedly entered into a contract with Solgen to install solar panels on the roof of her home. She sued Solgen, alleging fraudulent misrepresentation and other claims. Jones asserted in a declaration filed in response to Solgen\u2019s motion to compel arbitration that she was misled by its salesperson into believing that she was entering into a program with PG&amp;E that would reduce her energy bill and that he never told her that she was executing an arbitration agreement. There was also evidence that she only had 38 seconds to review a 21-page contract. The salesperson filed a declaration wherein he stated that he explained the nature of the contract to Jones and that she appeared to understand what he was saying.<br><br>The motion to compel arbitration was denied and Solgen appealed, arguing that the trial court erroneously imposed a requirement that it had to point out the arbitration agreement to Jones. The Court of Appeal affirmed, holding that the court's order could be read as not imposing such a requirement. There was an implicit conclusion within the trial court's order that Jones could not have validly entered a contract with an arbitration clause when the contract was 21 pages, the review period was 38 seconds through a cell phone, and that Jones was 81 years old with virtually no technological ability. This implicit conclusion could be undermined to some extent if appellant had submitted evidence that Jones specifically had been told about the arbitration clauses.
